Jolly Rent a Car d.o.o. rents the vehicle to the Customer whose details are stated on the front page of the Rental Agreement, subject to the following Terms and Conditions:
1. Acceptance of the Rental Agreement
By signing the Rental Agreement, the Customer confirms and agrees that:
- the prices and rental conditions set out in the current Price List form an integral part of this Agreement;
- the Customer is at least 21 years of age and has held a valid driving licence for a minimum of two (2) years;
- the vehicle is received in proper working condition together with all accessories and vehicle documentation, and any malfunction shall be reported to Jolly Rent a Car d.o.o. immediately so that it may be remedied as soon as possible;
- the rented vehicle will be properly secured and locked whenever left unattended;
- the vehicle will be returned at the agreed place and within the agreed rental period;
- any request to extend the rental period must be approved by Jolly Rent a Car d.o.o. at least 48 hours before the agreed return date;
- the vehicle will be used with due care and maintained in good condition throughout the rental period;
- the rented vehicle will not be used:
- a) while under the influence of alcohol or drugs;
- b) for any unlawful purpose;
- c) for driver training or instruction;
- d) for carrying passengers or goods for hire or reward;
- e) for towing trailers or other vehicles;
- f) for participating in motor races, rallies, competitions or similar events;
- the vehicle will be used solely for the Customer's personal needs and will not be rented, subleased or lent to any third party;
- the vehicle may only be driven by the Customer or by a person authorised by the Customer, provided that such person is at least 21 years of age, holds a valid driving licence and is registered in the "Additional Driver" section of this Agreement;
- the vehicle will not be overloaded beyond its legally permitted maximum weight;
- the vehicle will not be taken outside the territory of the Republic of Serbia without the prior written consent of Jolly Rent a Car d.o.o;
- no parts, components or equipment of the vehicle shall be modified, replaced or altered without the prior consent of Jolly Rent a Car d.o.o;
- the Customer shall bear the cost of all fuel consumed during the rental period.
2. Breach of Agreement
If the Customer breaches any provision of Article 1 of this Agreement, the Customer shall indemnify Jolly Rent a Car d.o.o. for all damages, losses and expenses resulting from such breach, the amount of which shall be determined by Jolly Rent a Car d.o.o.
3. Rental Charges and Other Costs
Upon the first request of Jolly Rent a Car d.o.o, the Customer shall immediately return the rented vehicle and pay:
- the agreed daily rental charge together with all additional charges calculated in accordance with the current Price List;
- all fines, penalties and administrative charges imposed on Jolly Rent a Car d.o.o. as a result of traffic violations or other offences committed by the Customer or any authorised driver during the rental period;
- all legal, court and attorney's fees incurred by Jolly Rent a Car d.o.o. in collecting outstanding amounts owed by the Customer.
4. Failure to Return the Vehicle
If the Customer fails to return the vehicle by the agreed return date specified in this Agreement and fails to settle all rental charges, Jolly Rent a Car d.o.o. shall have the right to:
- report the vehicle as unlawfully retained and initiate the appropriate legal procedures before the competent authorities;
- commence legal proceedings against the Customer for recovery of all outstanding amounts due under this Agreement and the applicable Price List;
- charge statutory default interest on all overdue amounts.
5. Third-Party Liability Insurance
During the rental period, the vehicle is covered by compulsory third-party liability insurance in accordance with the laws of the Republic of Serbia and up to the limits prescribed by applicable legislation.
6. Collision Damage (CASCO) Insurance
- In the event of a road traffic accident, the Customer must immediately notify the police so that an official accident report can be prepared. In such case, Jolly Rent a Car d.o.o. shall retain the entire security deposit.
- If the Customer is not responsible for the damage, and provided that the police have completed an official on-site investigation, the Customer shall bear no financial liability for the damage.
- In the event of theft or disappearance of the vehicle, Jolly Rent a Car d.o.o. shall retain the full security deposit.
- Damage caused by an unknown third party without a reported traffic accident, including damage occurring while the vehicle is parked, shall be covered by the Customer through the security deposit.
- If no police report has been prepared, or if there is no official police confirmation of the theft of the vehicle, the Customer shall be liable for 20% of the repair costs, or, in the event of theft, for the market value of the vehicle as of the rental commencement date.
7. Customer's Liability Regardless of Insurance
Regardless of the insurance coverage selected, the Customer shall remain fully liable for damage if:
- a) the damage was caused while the Customer or an authorised driver was under the influence of alcohol or drugs;
- b) the damage resulted from intentional misconduct or gross negligence;
- c) the driver did not possess a valid driving licence at the time the damage occurred.
8. Personal Property
Jolly Rent a Car d.o.o. shall not be liable for any loss of or damage to the Customer's personal belongings, luggage or goods left in or on the rented vehicle.
9. Limitation of Liability
Jolly Rent a Car d.o.o. shall not be liable for damages arising from:
- delay in delivering the rented vehicle;
- mechanical failure or breakdown of the vehicle during the rental period.
10. Customer's Obligations in the Event of an Accident
In the event of an accident, the Customer shall protect the interests of Jolly Rent a Car d.o.o, its insurance company and the Customer by:
- immediately notifying the traffic police and waiting for their arrival so that an official accident report can be prepared;
- not leaving the damaged vehicle until it has been moved to a safe location and properly secured;
- recording the names and addresses of all parties involved and any witnesses;
- notifying Jolly Rent a Car d.o.o. immediately, or as soon as reasonably possible, of any damage, regardless of its extent;
- submitting a written accident statement describing the circumstances and causes of the accident involving the rented vehicle.
11. Failure to Comply Following an Accident
If the Customer fails to fulfil the obligations set out in Article 10, the Customer shall be responsible for all damages, losses and expenses incurred by Jolly Rent a Car d.o.o. as a consequence of such failure.
12. Payment by Credit Card
Where the rental charges are paid by credit card, by signing this Agreement the Customer authorises Jolly Rent a Car d.o.o. to charge the issuing card organisation for all rental charges, including any damage for which the Customer is responsible, as well as all traffic fines and penalties incurred during the rental period.
13. Privacy Notice
The Customer confirms that he/she has received and read the Privacy Policy of Jolly Rent a Car d.o.o. and understands how personal data are processed in accordance with applicable data protection laws.
14. Governing Law and Jurisdiction
Any dispute arising out of or in connection with this Agreement shall be governed by the laws of the Republic of Serbia. The parties agree that the competent courts in Belgrade, Republic of Serbia, shall have exclusive jurisdiction.
